SACRAMENTO, WE HAVE A PROBLEM!

The problem is that despite Jessica's Law, John Albert Gardner III was 1) not sent back to prison for living near a school, and 2) thereafter, not sent indefinitely to the not so exotic Atascadero State Hospital because of his sex offender status. 

Gardner was on Parole when Jessica's Law was approved by the voters in California. He was living near a school after its passage, and according to the recent State Supreme Court decision of In re E. J., Jessica's Law, and it's residency provisions apply. He not only lived near a school, but he lived eight months after passage of Jessica's Law, and after his lease expired. Instead of being sent back to prison, and thereafter, sent to Atascadero State Hospital indefinitely, Gardner was a let-loose parolee with GPS monitoring.


If Gardner was in Atascadero in 2009, AND NOW, instead of being discharged from parole, Chelsea King and Amber Dubois would still be alive today.


WE NEED NEW "TOUGH ON CRIME" INITIATIVES, LIKE WE NEED HOLES IN OUR HEADS!


The reason why is in part, Jessica's Law wasn't being enforced. It's supposed to be enforced, but when you have Parole Officers in this case and in the Phillip Garrido case acting clueless and "way out to lunch" the law is one hell of a toothless wonder.


If we, as Californians, are going to get out of this predicament, then we should do the following:


1. RAISE TAXES.
2. Build more prisons.
3. Eliminate the Three Strikes Law only for nonviolent and nonsexual offenses.
4. Pay for inmate health care.


If we don't do these things, how are we going to keep the Garrido and Gardner types away from the public? If Gardner gets charged or indicted, he should just plea to be put in Death Row. He fucked it up for everybody, like what Richard Allen Davis did. BUT, if we are going to keep our children safe, telling a sex offender where to live doesn't keep the children safe. Gardner didn't always complied with sex offender registration, and was "visiting" his mother when Chelsea was raped and murdered. He also spent time during and after parole, trolling for victims. His residence might as well be the Escondido Freeway! 


HELLO! SCHWARZAFUCKER, ARE YOU LISTENING?!!!


If California First Lady Maria Shriver found out that Gardner was near any of their kids' schools, Maria would have a hemorrhage.  Her scream would be louder than the Loma Prieta Earthquake. 


If we are going to keep children safe, I'll agree that we need to keep all predators away in prison somewhere. As to PREVENT FURTHER PREDATORS IN THE FUTURE, we need to stop the victims from being abusers. Gardner was physically abused, and at least in one instance, was sexually abused. This moron needed a lot of help when he was a kid, not a 16-drug cocktail. If he acted "hyper" maybe it's because he was abused. Others stated that he has bipolar disorder, and that he killed Chelsea and Amber in part, because they may have looked liked his former girlfriend he had before he was convicted in 2000 in the first place.This guy needed help when he was a kid, but now he'll join the likes of other abused, like Ted Bundy, Brian David Mitchell, Richard Allen Davis, Joseph Edward Duncan III, etc. facing after the fact consequences of their abuse, because nobody helped them overcome it, and helped them get on with their lives. 


REPEAL JESSICA'S LAW!
